The Boston Athletic Association (B.A.A.) 5K (“Event”) is a serious athletic endeavor. By submitting this entry form or by participating in the Event in any manner, you are agreeing to comply with the following terms and conditions as a binding agreement between you and the B.A.A., and you certify the information you are providing is complete and correct.
I acknowledge and agree that:
- I have chosen entirely by myself the course(s) and/or manner of running or otherwise moving that I will employ for the Event, whether outdoors or indoors in any fashion such as a treadmill or other mechanical device (“My Course”). The B.A.A. has played no role in my selection of My Course and bears no responsibility for it.
- I will make all reasonable efforts to adhere to any health guidelines, regulations, and restrictions (including policies regarding masks and social distancing) that may be in place in the location where I complete the Event on My Course.
- I will complete the entirety of the distance of the Event continuously and on the same day by running or otherwise moving in a manner consistent with running.
- I will not transfer my official bib number or any Event-provided timing device (including any GPS-enabled tracking device or official account credentials), or my right to obtain it, to anyone or any organization for any purpose, including charity auction, lottery, or other fundraising efforts. I will submit an accurate time reflecting my participation in the manner provided to do so.
- The B.A.A. does not assume responsibility for my health, safety, security, or support in the Event and/or on My Course. Responsibility for medical costs of any kind associated with transport, care, and treatment that may arise out of my participation in the Event on My Course lies with me.
- Deferment of the Event entry into the any future race or event conducted by the B.A.A. will not be permitted for any reason.
I agree and acknowledge that participating in the Event organized as a virtual activity in which (i) I complete the distance on My Course, (ii) at a date and time of my choosing, (iii) in a location and route of my choosing, and (iv) that will not have any support, safety, or security measures provided by or put in place by the B.A.A., is a potentially hazardous activity that could result in injury or death. I agree and acknowledge that I am participating in the Event in the exercise of my own free will and at my own personal risk. I agree and acknowledge that it is my responsibility to understand the risks and determine whether I am fit to safely complete the Event on My Course and to understand and determine the precautions I should take to do so. I hereby attest and certify that my physical condition and ability to safely complete the Event have been verified by a licensed medical doctor (except where the latter is in violation of my religious principles) and that I am physically fit and have sufficiently trained to complete the Event. I further agree to read and abide by the World Health Organization’s (WHO), Centers for Disease Control’s (CDC), and/or applicable local authority’s recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases. I understand and agree that if my community imposes a shelter in place order or advisory, I will abide by the terms of any such order or advisory. I agree that I am solely responsible for determining whether and which orders or advisories may apply to My Route. I further understand the importance of and agree that I shall follow all pedestrian and other safety laws or regulations applicable to My Course.
I attest that I have read the rules of the Event scheduled for April 16, 2021 through April 18, 2021, including the terms in this waiver, and agree to abide by them. I assume all risks to me associated with completing the Event on my own as part of this activity, including but not limited to: falls, contact with other pedestrians, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road or trail, all such risks being known or unknown and appreciated by me when out running or otherwise moving on my own without any type of support from local officials or Event organizers.
In consideration of accepting this entry, I hereby, for myself, my heirs, executors, and administrators, waive and release any and all rights and claims for liability and damages I now have or may in the future have against the Boston Athletic Association (B.A.A.), its employees, agents, officers, governors, and sponsors, and their representatives, successors and assigns, for any and all injuries or death suffered by me in or arising from or related to the Event. I agree to abide by all rules and guidelines of the B.A.A. I grant to the B.A.A. and its sponsors and licensees the exclusive right to the free use of my name, voice, and/or picture in any broadcast, telecast, advertising, promotion, or other account of the Event, except when usage suggests an endorsement of any product or service without my consent. I agree that the B.A.A. may publish my Personal Information (defined below) as part of the results of the Event. Personal Information here may include, without limitation, name, any club affiliation, race times, occupation, town of residence, and age category. If I choose to make a donation to one of the B.A.A.'s charity partners, I agree that the following information may be shared with the charitable organization that I selected: my name, mailing address, email address, and amount donated. I agree and acknowledge that the online operation of the Event will utilize a third-party platform and that I will be required to accept the terms and conditions of that third-party platform in order to participate in the Event. I acknowledge that my entry fee is non-refundable, non-deferable, and non-transferable, even if the Event is cancelled, and that if the Event is cancelled the B.A.A. has no obligation to me for any expenses that I may incur pertaining to my planned participation. I agree that any legal claim or dispute arising out of or in any way relating to my participation in the Event shall be governed by the laws of the Commonwealth of Massachusetts, USA, and will be adjudicated exclusively by and in, and I hereby submit to the exclusive jurisdiction of, the federal and state courts located in the Commonwealth of Massachusetts, USA.
